Non-filed Returns

If you wait for the IRS to file your returns for you, they are filed in the best interest of the government, usually with little or none of the deductions you are entitled to.

 

Before anything can be done to extract you from this predicament all the returns must be filed. You must be current. In most cases, you will likely owe taxes, interest, and penalties after the returns are filed. Once we see how much is owed, we’ll set a course of action to get you off the hook!

Payroll Tax Problems

If you own a business and have employees, you are probably all too familiar with the issues regarding calculating and paying payroll taxes. With all of the federal and state calculations for payroll taxes, it can be confusing to figure out how much to pay, how often to pay it and what to do if you find yourself in a situation where you can’t pay.

 

Many businesses either fail to calculate the correct amount of payroll taxes or fail to get their payroll taxes completed in a timely fashion. This leads to penalties, interest accruals and eventually, an unmanageable situation of business tax debt.

 

In addition to it being easy for a business owner to miscalculate or miss payments for payroll taxes, the state or IRS may not notice the problem for months or even years. Over that time, penalties and interest accrue while debt grows to the point that it becomes difficult to pay the taxes, penalties and interest in full.

IRS Audit Representation

Nothing strikes fear in the hearts of people more than receiving an IRS Audit letter in the mail. Audits take significant time away from your business and family, requiring you to gather mounds of records substantiating each and every item reported on your tax return and develop a comprehensive understanding of tax law.

 

Many taxpayers decide to handle a tax audit themselves, and discover they may have been “penny wise,” avoiding a representative’s fee, but “pound foolish,” because they received a substantial bill for a significant tax deficiency.

Liens & Seizures

Liens

 

When your taxes are not paid the IRS establishes a lien against all of your assets (especially real estate). This gives the IRS the legal right to collect taxes from the sale of your assets, which includes just about everything you own.

 

The lien can be against you, your spouse, or your company. A lien against your company would seize your accounts receivables. At this point everything you own is put at risk.

 

Liens filed against you by the IRS also show up on your credit report and often prevent you from opening a checking account or borrowing against any assets, like your home. The banks don’t want the extra work when the IRS comes in to take your money.

 

 

Seizures

 

Unlike the levy which involves intangible assets such as your bank account, a seizure is the taking of physical assets, such as your home or car. Seizures usually happen in aggravated cases when someone ignores many requests by the IRS over a long period of time to pay their outstanding taxes.

 

A Seizure should not be taken lightly. The IRS will ultimately pursue seizure of your physical assets. Don’t think they won’t. When the IRS seizes your assets they want to quickly sell them at auction. 

Levies & Garnishments

Levies

 

A levy is the IRS’s way of getting your immediate attention. What they are saying is, we have tried to communicate with you but you have ignored us. Levies are used to seize your wages and whatever other assets you have. That includes checking accounts, auto’s, stocks, bonds, boats, paychecks, and even Social Security checks!

 

Their sole objective is to collect the taxes owed. Period.

 

We are often able to get those levies released and help you get out of this terrible situation. Our goal is to get you even with the IRS, with what you can afford, and let you start life anew.

 

 

Garnishments

 

As bad as that is, a worse method is a wage levy (or garnishment). That’s when most of your pay check goes to the IRS, they don’t leave you enough to pay the bills, and most of your check goes to the IRS each and every week until the debt is paid.

 

You received a notice of “intent to Levy” 30 days ago and you forgot or ignored it. Now it’s Payday. Expecting a check, you open the envelope and find that the IRS has taken most of your money. What’s left is not enough to pay the rent, car payment, buy groceries, or pay the rest of the bills. This action will continue on every check due you, until the tax owed is paid in full.

We are regularly retained to negotiate the release of IRS wage garnishments by arranging a payment plan.

 

The payment plan negotiated by us is always more favorable than any IRS wage garnishment. It allows you to receive your whole paycheck without fears of future wage garnishments.

Innocent Spouse Relief

Marriages don’t always work out the way you expect. Dealing with marital issues, separation or divorce is enough of a headache; you shouldn’t need to worry about your spouse’s (or ex-spouse’s) tax debt. Fortunately, the IRS has a Relief provision for spouses who aren’t directly responsible for this debt. This is known as IRS Innocent Spouse Relief.

 

The most common criteria for innocent spouse eligibility are:

 

  1. You filed a joint return.
  2. There were omitted or erroneous items on the return that the innocent spouse had no knowledge of when the return was filed with the IRS.
  3. You can prove that you didn’t know of issues or had no way to know about them when the return was filed. This is very important and one of the most difficult hurdles to overcome in the negotiations.

 

Ultimately, there are many variables to consider – including whether or not you reside in a community property state – that will help you determine how to best tackle an Innocent Spouse Relief request. These requests can work out in your favor. However, due to the complex conditions required for Innocent Spouse Relief to be granted, it’s not recommended that you do it without the help of a professional.

Trust Fund Recovery

A Trust Fund Recovery Penalty (TFRP) involves the collecting of employment taxes by the IRS from the owners or corporate officers of a business that has failed to pay the employment taxes. The TFRP allows the government to reach parties otherwise shielded from tax liability, such as officers, shareholders, employees or a corporation, partnership or LLC, and in some cases, outside entities.

 

These taxes include Social Security and Medicare, as well as Federal Income taxes that are collected by the employer from employees and held “in trust” until due and payable.

 

When a business fails to pay the IRS its employment taxes, the IRS will aggressively attempt to collect these taxes using tax liens and levies against the bank accounts, investments and property of the business.

 

Depending on the situation, the IRS Revenue Officer may assess a TFRP against individuals involved in the business who have control over the use and disposition of the business’s assets. These individuals may have decision-making authority in connection with the payment of the business’s liabilities, and can be seen as “willfully” failing to pay the business’s Withholding Taxes.

 

The held taxes belong to the U.S. government, not the business, and have simply been held in trust by the business. Therefore, the IRS has full legal authority to assess and collect on a TFRP.
